Former Baylor head coach, athletic director testified in Title IX trial

Former student Dolores Lozano is accusing former Baylor running back Devin Chafin of domestic abuse.

WACO, Texas — As the Title IX lawsuit against Baylor University continues, former Baylor Football Head Coach Art Briles and former Baylor Athletic Director Ian McCaw took the stand in an emotional testimony explaining their knowledge of what took place during their time on campus.

Former student Dolores Lozano is accusing former Baylor running back Devin Chafin of domestic abuse. Lozano believes Baylor didn't do enough to stop it or investigate the alleged assault properly.

Lozano was a part of a lawsuit filed in 2016 involving fifteen other women accusing the university of neglecting them after they were sexually assaulted by football players and other students.

In court, Briles told the jury he was not at all aware of Title IX when he began his head coaching position at Baylor in 2007.

 "Do you think it was Baylor's responsibility to train you on Title IX," The plaintiff asked Briles on the stand. "I would certainly think so," Briles responded.

He went on to say at the time of the alleged domestic abuse involving Chafin and Lozano in Spring 2014, he had no training on how to handle Title IX reports. 

Text messages between Briles and other Baylor staff were shown to the jury. 

These texts showed conversations about a handful of football players violating Baylor's code of conduct policy. Violations include marijuana possessions and DWI.

In this domestic abuse case involving Chafin and Lozano, Briles admitted most of his coaching staff and some school officials knew about the alleged incident before he did . He said he was not apart of any sort of cover up and never discouraged victims to come forward. 

Briles began getting emotional when speaking about his current unemployment and how Baylor handled his termination.

"I felt defamed," Briles told the jury in tears. 

The plaintiff was making the case of the proper chain of command also not being followed once staff was made aware of the allegations. 

McCaw was hired at Baylor in 2003. When he testified, he said he only learned about Title IX in the fall of 2012.

He said he was made aware of the Chafin and Lozano allegations during a weekly meeting with Nancy Post and other staff. 

McCaw admitted that when he found out about the alleged domestic abuse, he did not document the claims in any sort of data base and didn't put the information on any record. He also never told Briles about the incident.

Trial is expected to continue Friday, Oct. 20 in Waco.
