Med spa doctor allowed to resume practice under 'temporary restrictions'

A disciplinary panel rules med spa doctor 'a continuing threat to public welfare.'

AUSTIN, Texas — The Frisco doctor temporarily suspended by the Texas Medical Board in the death of Jenifer Cleveland at Luxe Med Spa in Wortham, will now be able to resume practicing medicine but with restrictions.

According to the Texas Medical Board, on December 18th, a disciplinary panel temporarily restricted the Texas medical license of Dr. Michael Patrick Gallagher after determining, "...his continuation in the unrestricted practice of medicine poses a continuing threat to public welfare." 

The restriction is effective immediately.

Dr. Gallagher is now restricted to the practice of anesthesiology and is restricted from supervision and delegation in all circumstances.

According to the Texas Medical Board Bulletin, "Dr. Gallagher shall not be permitted to supervise or delegate prescriptive authority to a physician assistant, advanced practice nurse, surgical assistant, or anyone regardless of whether they are licensed or not."

The report goes on to state, "The Board panel found that Dr. Gallagher failed to properly supervise an unlicensed individual performing intravenous (IV) treatments, including administering prescription pharmaceutical solutions, resulting in complications that staff were not trained or prepared to manage, resulting in a patient's death."

The temporary restrictions remains in place until the board takes further action.

The criminal investigation into the death of Jenifer Cleveland is on-going according to the Wortham Police Department. 

The autopsy report, obtained by 6 News listed the manner of Cleveland's death as "undetermined." The report stated, "The administration of IV therapy cannot be definatively ruled-in or ruled-out as contributory at this time."

Cleveland was a beloved member of the 99.1 KNES Radio family in Fairfield.

The Luxe Med Spa in Wortham closed after Cleveland's death. An attorney representing the owner, Amber Johnson says his client is not responsible for Cleveland's death and "will leave no stone unturned" in investigating Cleveland's death.
