McGregor shooting suspect examination findings presents light on why he is incompetent to stand trial

Doctors examining Nicolas Jaimes-Hernandez were split in finding the McGregor shooting suspect fit to stand trial.

MCLENNAN COUNTY, Texas — On Thursday, the McLennan County District Attorney's Office explained why the McGregor shooting suspect, accused of shooting and killing five people in September 2022, is incompetent to stand trial.

Nicolas Jaimes-Hernandez, 37, was deemed incompetent to stand trial in October after doctors reported inconclusive results on Jaimes-Hernandez's mental state, according to First Assistant District Attorney Ryan Calvert.

"After considering the available options, our team elected to agree to a finding of incompetence on Mr. Jaimes-Hernandez," Calvert stated. "After one doctor found him incompetent, and another could not tell whether he was competent, a third opinion, even if favorable, would not have definitively resolved the competence issue."

Calvert explained the McLennan County DA's Office seeks justice for the victims and the community. 

"Our ultimate objective is to do justice for these victims and for this community," Calvert said.

Jaimes-Hernandez is accused of killing 38-year-old Monica Delgado, 15-year-old Miguel Avila, 14-year-old Natalie Avila, 47-year-old Lorena "Lori" Aviles and 20-year-old Natalie Aviles on Sept. 28, 2022.

Legal proceedings are paused until medical examinations declare that Jaimes-Hernandez can stand trial. Until then, he will be reportedly transferred to a mental health center where medical professionals will work to restore his competence through medication and treatment. 

"While there, medical professionals will medicate him and work to restore competence. If that facility eventually deems him competent, then the case can proceed," Calvert explained. 

According to police, Jaimes-Hernandez fired at officers when they arrived on the scene, and was shot by the police before being taken into custody.

Initially deemed incompetent to stand trial in July 2024, Jaimes-Hernandez was scheduled for a competency trial in 2025.
