Title IX lawsuit against Baylor University continues in court

This is part of a lawsuit filed in 2016 accusing the university of neglecting them after they were sexually assaulted by football players and other students.

WACO, Texas — Testimony continued in a Title IX lawsuit against Baylor University in a Waco federal courtroom Wed. Oct 18, getting into the specifics of a troubled relationship and learning how Baylor staff reported an alleged assault.

Former student Dolores Lozano is accusing former Baylor running back Devin Chafin of domestic abuse. Lozano believes Baylor didn't do enough to stop it or investigate the alleged assault properly.

Lozano's was a part of a lawsuit filed in 2016 involving fifteen other women accusing the university of neglecting them after they were sexually assaulted by football players and other students.

This case was all part of the 2015 Baylor sexual assault scandal that ended in the termination of head football coach Art Briles and the eventual resignation of Baylor president Ken Starr.

They've settled most of those suits out of court, but not Lozano's case.

In court on Wednesday, the doctor who treated Dolores took the stand and answered questions about her history before, during, and after the alleged assault.

The doctor told the jury from 2012 to 2015, Doloras and Chafin had a rocky relationship.

She mentioned how in 2014, Doloras got pregnant. When she told Chafin about the pregnancy, the doctor says that's when Chafin began striking Dolores, then eventually pushed her to the ground and began kicking her in the stomach.

She also said Dolores got an abortion not long after the alleged assault and began dating Chafin again. 

However, the doctor testified that this is common for domestic violence victims.

The lawsuit is alleging that Baylor failed to have a proper system in place for her to report the abuse.

Former Baylor assistant athletic director of financial management Nancy Post also took the stand to address that claim.

She says Lozano told her about the alleged assault in Spring 2014 and soon after told former human resources director John Whealin. 

She admitted nothing was documented about the alleged assault and nothing was officially reported to Title IX because there was no formal training on how to handle domestic violence cases.

Not long after this incident, a task force was created to better assist victims and document cases.

This trial will continue with Briles and former athletics director Ian McCaw expected to take the stand.
