Ground Game Texas withdraws lawsuit against City of Harker Heights, City officials say

The organization filed a lawsuit in November 2023 after the City failed to change its marijuana policies following the approval of Proposition A.

HARKER HEIGHTS, Texas — Ground Game Texas has reportedly withdrawn a lawsuit against the City of Harker Heights, according to a release by the City.

Harker Heights Assistant City Manager Jerry Bark shared Notice of Nonsuit and Certificate of Service documents with 6 News on Monday, April 1.

Ground Game Texas filed a lawsuit against the City of Harker Heights in November 2023 after the City failed to change its marijuana policies despite voters approving Proposition A, which directed police not to go after people found to be in possession of small amounts of marijuana.

Citizens voted to approve the proposition in November 2022, though some residents claimed the City disregarded the election by not changing its enforcement policies on marijuana.

Julie Oliver, Executive Director of Ground Game Texas, said the lawsuit was about "enforcing the will of the voters" and that Harker Heights officials were "undermining local democracy by disregarding the clear language of the city charter."

A release from the City of Harker Heights stated it would be "inappropriate" for the City to comment on why Ground Game Texas decided to withdraw the lawsuit. No explanation has been given at this time.

"The City has been confident in its position from the beginning of this process and that confidence remains," said Bark in the release.
