6 Fix | Whitney family unhappy with new deck, home work while contractor said he's still owed money for past work

A Whitney family says they are down $5,500 for work on their deck and kitchen, but the contractor said the full invoice hasn't been paid.

WHITNEY, Texas — Patience Nunez of Whitney, TX said she contacted Brother's Roofing and Remodeling back in the summer of 2022 for an estimate on a deck for her front porch and work on repainting the inside of their home.

As time went on, Nunez said near the end of the project, she was not satisfied with the work.

"The boards are starting to sink and bow in the middle, the railing is not even connected to the step board," Nunez said.

Nunez said she believes the job is incomplete, after spending $4,000 for the deck and $1,500 for repainting her kitchen, work she says is subpar and unfinished.

"It's not even connected," Nunez said, pulling the railing off from the side of the deck. "We just weren't happy with it, it didn't look right."

Nunez said the deck is unbraced, with legs only on the side and nails protruding from the steps. She feels it's unsafe to spend time on it in this condition.

"We've left numerous voicemails, we've left emails, we've left a number of calls and no contact," Nunez said.

Inside the kitchen, Nunez showed 6 News the holes left in the wall that were puttied and painted over by Brothers. She said the contractors didn't even bother to paint behind her washer and dryer.

Nunez said the contractors were working two to three hours at a time, would leave multiple days in a row before returning to work and would make frequent trips to Waco to go get supplies.

Nunez said the workers even painted over her light switches and backsplash tape on the kitchen wall.

Nunez said the workers also parked on her lawn during the summer on a work day and in the heat set fire to her grass which she had to extinguish with a mop bucket.

"We asked him several times 'Don’t park in the yard'," Nunez said. "That year we were under severe drought and they parked in our yard and almost set our house on fire."

Despite Nunez's efforts to contact the company, however, Brothers said they're still owed money for the work that's already been done and won't be doing more until they're paid.

However, Nunez claims there were workers she caught drinking alcohol on the job while out on her front lawn.

Brothers disputed those claims and provided this statement to 6 News:

"I apologize that the customer feels as though our work here at Brothers Roof and Remodeling did not meet their standards. We did our best in Texas summer heat 2023. We did the patio deck which they did a walk-through and approved it. Then they asked us to do the interior paint and when we got done, we were unable to do a walk-through with them as they did not stay in the home during remodeling. I tried calling and texting to let them know we needed to do a final walk around so they avoided us at Brothers Roofing and Remodeling and didn’t pay us or even communicate back to us. We even sent letters trying to communicate. This could all have been easily fixed with communication and of course payment for work. All they paid for was a deposit for a payment plan which they did not follow or even the materials for the paint job. We were willing to do the touch-up for them or fix anything they requested if they would communicate with us, & another thing, my guys or us would NEVER DRINK on the job. We are respectful & professionals. I have references that would back us up on our work. I think this client just didn’t want to pay us for our services. And if you have any questions or concerns please don’t hesitate to give me a call."
