WORTHAM, Texas — The Texas Attorney General's Office will take over the case of Jenifer Cleveland, Freestone County District Attorney Brian Evans confirmed to 6 News on Friday, April 19.
Cleveland died in July 2023 after undergoing a procedure at the Luxe Med Spa in Wortham, Texas, according to police. An autopsy report listed the manner of Cleveland's death as "undetermined", but the Texas Medical Board stated Cleveland received an IV infusion containing Vitamin B complex, ascorbic acid, cyanocobalamin and TPN electrolytes.
Cleveland was reportedly found unresponsive after the IV treatment. She was taken to a hospital in Mexia, where she later died, police said.
According to the Texas Medical Board, TPN electrolyte solution requires a prescription and is "known to cause complications due to the potassium chloride in it".
The spa's owner, Amber Johnson, was reportedly able to order TPN and other prescription solutions using the credentials of Michael Patrick Gallagher, M.D., a physician who was serving as the medical director of the spa at the time of Cleveland's death.
In October 2023, the Texas Medical Board suspended Gallagher's medical license, stating that there were no "protocols, policies or procedures pertaining to the administration of IV treatment" and that staff at Luxe Med Spa were performing treatments that required medical licensure, but there were no medically licensed or experienced personnel at the facility when IV therapy was being administered.
Gallagher has since been allowed to continue practicing medicine under restrictions.
Luxe Med Spa reportedly closed after Cleveland's death. An attorney representing Johnson says she is not responsible for Cleveland's death and "will leave no stone unturned" in investigating her death.
Evans said the Attorney General's Office will be taking over the investigation, however, the case will remain in Freestone County.
Evans told 6 News if the Attorney General's Office decides to take charges to a Grand Jury, it will still be the Freestone County Grand Jury. Any indictments in the case would reportedly take place in Freestone County as well.
