Accused McGregor shooting suspect deemed incompetent to withstand trial, says family of victims

Nicolas Jaimes-Hernandez is accused of shooting and killing five people in McGregor in 2022.

MCGREGOR, Texas — The man accused of shooting and killing five people in McGregor in September 2022 has been deemed incompetent to withstand trial, family members of the victims told 6 News.

Olivia Perez, the sister of Lorena "Lori" Aviles, one of the victims, confirmed to 6 News that the McLennan County District Attorney's Office called family members of those who were killed to tell them that Nicolas Jaimes-Hernandez had been deemed unable to withstand trial.

"This decision sends the very wrong message to anyone across our nation, community and our state," Perez said. "It suggests that such a grievous act can be excused without proper justice being served. We implore those in the Mclennan County Justice Department to do what is right. We ask you to ensure that justice is served for the sake of our family, our community and to uphold the integrity of our legal system."

Jaimes-Hernandez is accused of shooting and killing 38-year-old Monica Delgado, 15-year-old Miguel Avila, 14-year-old Natalie Avila, 47-year-old Lorena "Lori" Aviles and 20-year-old Natalie Aviles on Sept. 28, 2022.

Jaimes-Hernandez was indicted in November 2022 on two counts of capital murder and two counts of aggravated assault.

According to police, Jaimes-Hernandez fired at officers when they arrived on the scene, and was shot by the police before being taken into custody.

According to family, Jaimes-Hernandez was Monica Delgado's husband, but not the father of Miguel and Natalie Avila. Lorena and Natalie Aviles were reportedly Delgado's neighbors.

Perez said a second evaluation will be done to further examine Jaimes-Hernandez.

"We just we just ask that all of the suffering that the families are going through, that it not be in vain and let justice be served," Perez told 6 News.
