Central Texas family still calling for justice after being hit by alleged drunk driver in May

Sanjuana Escalante and eight other family members all miraculously survived the crash. Now they are fighting for justice.

SAN ANTONIO, Texas — A Central Texas mother is still recovering from injuries she suffered in a head-on collision back in May

The other driver was allegedly drunk when it all happened. Sanjuana Escalante and eight other family members in the car that was hit all miraculously survived.

Escalante knows her road to recovery will be a long one.

"All I ask is if I can dance again," Escalante said. "That's it. As long as I can dance."

The 46-year-old mother is a busy mom, usually working long hours to provide for her family.

"She's been out of work since May, and it's not something that she wants," Guadalupe Sariana, Escalante's daughter, said.

Escalante and her family of eight were only five minutes from home when a teenager drove into her car head-on.

"I still can't bend my elbow," Escalante told 6 News. "I still have the bruises. I'm only 46, and my life is really at the end, to tell the truth."

With scars still fresh almost a year later, Escalante and her family sit back at a loss for what to do. They have gone through dozens of lawyers, only to be met with the same answers.

"She didn't have uninsured motorist [coverage]," Sariana added. "She didn't have personal injury protection. That's their reason why they can't help even though she had full coverage."

The family says some lawyers claim they will have to pay $20,000 just to file a lawsuit.

"That's just like a slap in the face," Sariana said. "It's like everywhere we go to just try to find help, it's like a roadblock and it shouldn't be like that. I feel like a lawyer should take this quick. This should be like a win-win scenario."

The family says what hurts more is the lack of accountability.

18-year-old Vanessa Alvarado is charged with intoxication assault.

"She was in jail one day and then her mom bailed her out," Escalante said. "She knows she messed up, I mean she could come tell me, 'I'm so sorry. Anything I could do?' No, not even, nothing like that. No self remorse."

6 News called Bexar County. They say the suspect, Alvarado, is charged with two intoxication assault charges. She is currently out on bond awaiting indictment.
